Brazil ANATEL Act 5314/2026 | Mandatory Certification for Stationary Telecom Lithium Batteries

On April 14, 2026, Brazil's National Telecommunications Agency (ANATEL) officially issued Act No. 5314/2026 (Ato n° 5314/2026), explicitly stipulating that stationary application lithium-ion secondary batteries shall be included in the scope of ANATEL mandatory certification. The act will be enforced mandatorily from October 12, 2026. This marks a comprehensive upgrade of regulatory requirements for energy storage systems in Brazil's telecommunications industry, directly affecting all products targeting the Brazilian market including communication backup power supplies, base station energy storage batteries, and UPS supporting batteries.


01 Mandatory Product Scope

Per the provisions of Ato 5314/2026, the regulation applies to stationary lithium-ion secondary batteries installed with communication equipment under medium and high discharge intensity environments, which must meet all of the following conditions:

  • Product Type: Stationary lithium-ion secondary batteries (with BMS);
  • Nominal Voltage: 24V or 48V;
  • Design Life: ≥ 10 years (under 25°C float charge conditions);
  • Application Scenario: Used for power supply or backup power of telecommunications equipment.

In addition, batteries must be equipped with a Battery Management System (BMS) and meet functional requirements for communication, protection and monitoring. The certificate holder must be a local Brazilian company (importer/distributor). The regulation classifies such products as Category III telecommunications products under the home communications category.


02 Test Standards

Ato 5314/2026 mandates testing based on the following Brazilian national standards:

  • ABNT NBR 16975:2021 — Electrical Specifications and Test Methods for Lithium-Ion Secondary Cells and Batteries for Stationary Applications (electrical performance testing);
  • ABNT NBR 16976:2021 — Safety Requirements Specifications and Test Methods for Lithium-Ion Secondary Cells and Batteries for Stationary Applications (safety testing);
  • BMS Communication Protocol: Must support MODBUS protocol, providing data such as voltage, temperature, SOC (State of Charge), SOH (State of Health), and alarm status.

In addition, the regulation also references EMC test standards including IEC 61000-4-2 (Electrostatic Discharge Immunity), IEC 61000-4-4 (Electrical Fast Transient/Burst Immunity), and IEC 61000-4-5 (Surge Immunity).


03 Certification Cycle & Maintenance Requirements

This certification adopts the type testing mode. After the certificate takes effect, a periodic review of the product and production management system shall be conducted every three years to continuously ensure that the product complies with regulatory requirements. As Category III home communications products, the re-evaluation cycle is once every 3 years.
