The U.S. Consumer Product Safety Commission (CPSC) and U.S. Customs and Border Protection (CBP) have jointly issued a new electronic filing (eFiling) regulation: effective July 8, 2026, all imported consumer products under CPSC jurisdiction must submit electronic compliance certificate data via the Customs Automated Commercial Environment (ACE) system at customs clearance. This marks the official end of the "random inspection and release" model for paper compliance certificates, replaced by digital supervision with automated system verification and per-shipment mandatory audit.
For cross-border e-commerce enterprises exporting to the US, hundreds of electronic products including lithium battery packs, battery-powered electric toys, chargers, portable energy storage power stations, LED luminaires and small home appliances fall under the scope of this new regulation. Goods failing to complete eFiling before customs clearance will face severe consequences including detention, return shipment or even destruction.
Urgent Reminder: With only about two weeks left before the mandatory implementation on July 8, 2026, enterprises under CPSC jurisdiction must immediately start compliance preparation.
Compliance Timing: From post-entry remedy to pre-entry prerequisite Under the old model, enterprises only needed to provide compliance certificates when randomly inspected, with buffer time available. The new regulation requires eFiling to be completed before customs declaration, making compliance a precondition for clearance.
Certificate Format: From PDF attachments to structured data Paper or scanned compliance certificates are completely invalidated. All compliance data must be entered into the ACE system item by item in structured format; uploading PDF files as a substitute is no longer supported.
Supervision Method: From manual random inspection to AI automated cross-verification The ACE system conducts multi-dimensional cross-verification via HTS commodity codes, importer information, manufacturer information, test report data and other factors; any inconsistency or incompleteness will trigger interception.
Coverage Scope: From small parcel exemption to no exemption for all categories Low-value parcels under $800, samples and gifts are all brought under supervision, no longer enjoying exemption treatment.
Violation Consequences: From supplementary document release to direct entry denial If data fails verification, the system will directly deny the goods entry into customs clearance, with no remedy space for "post-entry supplementary documents". Starting from January 2027, this rule will also be extended to goods in U.S. Foreign Trade Zones (FTZ).
Per CPSC's eFiling implementation guide, each import declaration must provide the following 7 structured data items (PDF cannot be used as substitute): ● Product Identification Information: Product name, model, SKU, UPC barcode, which must be strictly consistent with the actual goods. ● Applicable Safety Standard Clause Numbers: Accurate citation of CPSC federal regulation standard clauses, such as UL 2054, ANSI/CAN/UL 62368-1, ASTM F963-17, etc. ● Importer/Manufacturer Information: Full legal company name, U.S. physical address, contact phone number and email; overseas sellers must appoint a U.S. authorized agent. ● Certificate Record Custodian Information: Entity responsible for keeping test reports, including complete contact information. ● Production Date & Location: Year and month of final product assembly, city and country of production. ● Compliance Test Date & Location: Year, month and specific location of test completion. ● Third-Party Laboratory Information (mandatory for children's products): Name, address and laboratory identification code of CPSC-accepted laboratory.
Lithium battery packs, battery-powered electric toys, chargers, power adapters, portable energy storage power stations, digital products, etc. Testing must be completed per standards including UL 2054, UL 1642, ANSI/CAN/UL 62368-1, etc., to obtain a GCC certificate.
LED luminaires, small home appliances, extension cords, plugs and sockets, electric heaters, etc., which must comply with electrical safety and fire protection related standards.
Electric toys, remote control cars, early education machines, etc. designed for children under 12 years old. Test reports (including ASTM F963, lead/phthalates, etc.) must be issued by CPSC-accepted laboratories before a CPC certificate can be issued.
Adult and children's apparel, mattresses, curtains and other home textiles, with key supervision on flame retardancy and drawstring safety.
● Direct Cargo Detention: If no compliance data is found in the ACE system, the entire container will be detained at the port. ● High Civil Penalties: Maximum penalty of approximately $120,000 per violation, and up to $150,000 for intentional violations. Total CPSC penalties in fiscal year 2023 exceeded $52 million. ● Mandatory Return or Destruction: Non-compliant goods may be forcibly returned or destroyed by CBP, with enterprises bearing high costs. ● Platform Account Risks: Frequent violation records may lead to delisting on platforms such as Amazon, affecting business qualifications.
● Late June 2026 (Immediate): Conduct full SKU inventory, confirm whether products fall under CPSC jurisdiction, verify certificate validity and model matching. ● Late June ~ Early July 2026: Complete product testing and certificate preparation, obtain test reports required for GCC/CPC. ● Early July 2026: Complete system integration testing with customs brokers, conduct at least one eFiling test declaration. ● From July 8, 2026: eFiling electronic declaration must be completed for every customs declaration of CPSC-regulated consumer products shipped to the US.
